Terms of Service
Welcome to Stash. These Terms of Service ("Terms") govern your use of the Stash mobile application, stashers.app website, and related services (collectively, the "Service") operated by 5Tree LLC ("we," "us," or "our").
By accessing or using Stash, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Service Description
Stash is a real-time, hyperlocal marketplace that connects local merchants with consumers to reduce food and beverage waste. Merchants list surplus items at discounted prices; consumers browse, claim, and pick up items in person.
Stash is a marketplace platform. We facilitate transactions between merchants and consumers but are not a party to the sale of food or beverages. We do not prepare, handle, or deliver food.
2. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) to use Stash. By creating an account, you represent that you meet this requirement.
3. Accounts
3.1 Account Creation
You may create an account using Google Sign-In, Apple Sign-In, or email registration. You agree to provide accurate information and keep your account credentials secure.
3.2 Account Types
- Consumer Account: Browse deals, claim items, and complete redemptions via the mobile app.
- Merchant Account: List deals, manage inventory, and receive payouts via the web dashboard.
3.3 Account Termination
You may delete your account at any time. We may suspend or terminate your account for violations of these Terms, fraudulent activity, or excessive no-shows.
4. Consumer Terms
4.1 Claiming Deals
When you claim a deal, a $1.00 pre-authorization hold is placed on your payment method. This is not a charge — it is a temporary hold to verify your payment method and discourage frivolous claims.
Upon successful redemption, the full deal price is charged to your payment method. The $1.00 hold is released and replaced by the actual transaction amount.
4.2 Stash Code & Redemption
Each claim generates a unique 3-digit Stash Code. You have 15 minutes to arrive at the merchant and complete the redemption. Present your Stash Code and use the Swipe to Redeem feature to confirm pickup.
4.3 No-Show Policy
If you fail to redeem a claim within the allotted time:
- The $1.00 pre-authorization is captured as a restocking fee and credited to the merchant.
- Your claim is cancelled and the item is returned to available inventory.
- Progressive consequences apply:
- 1st no-show: Warning notification
- 2nd no-show: Warning notification
- 3rd no-show: 24-hour claim cooldown
- You may have a maximum of 2 active claims at any time.
4.4 Refunds
Because Stash deals involve perishable goods claimed in person, all sales are final once redeemed. If you experience an issue with a claimed item (e.g., quality concern, incorrect item), contact us at support@stashers.app within 24 hours.
5. Merchant Terms
5.1 Merchant Onboarding
Merchants must complete Stripe Connect onboarding, including identity verification (KYC) and bank account setup, before listing deals.
5.2 Deal Listings
Merchants are responsible for the accuracy of their deal listings, including item descriptions, quantities, pricing, and expiration times. Misleading or inaccurate listings may result in account suspension.
5.3 Commission
Stash charges a 20% commission on each completed transaction. Payouts of the remaining 80% are processed via Stripe Connect to the merchant's linked bank account according to Stripe's standard payout schedule.
5.4 Stash Boost
Merchants may purchase Stash Boost ($5.00 per boost) to send a priority push notification about their deal to all consumers within a 5-mile radius.
5.5 Stash Pro
Merchants may subscribe to Stash Pro ($49/month) for enhanced analytics, automated deal posting, and impact reporting.
5.6 Food Safety
Merchants are solely responsible for compliance with all applicable food safety laws, health codes, and regulations. Stash does not inspect, prepare, or guarantee the quality or safety of any food or beverage listed on the platform.
6. Payments
All payments are processed by Stripe, Inc. By using Stash, you also agree to Stripe's Terms of Service and Privacy Policy.
We do not store your full payment card information on our servers. All payment data is handled securely by Stripe in compliance with PCI-DSS standards.
7. User Conduct
You agree not to:
- Use the Service for any unlawful purpose
- Create fake accounts or impersonate others
- Manipulate reviews or ratings
- Interfere with or disrupt the Service
- Attempt to access another user's account
- Use automated tools to scrape or interact with the Service
- Abuse the claim system (e.g., claiming with no intent to redeem)
8. Reviews & Ratings
Users may leave reviews after completing a redemption. Reviews must be honest and based on your genuine experience. We reserve the right to remove reviews that contain harassment, hate speech, spam, or unrelated content.
9. Intellectual Property
The Stash name, logo, and all associated branding are trademarks of 5Tree LLC. The Service and its original content (excluding user-generated content) are protected by copyright and other intellectual property laws.
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE:
- The availability, accuracy, or quality of deals listed by merchants
- That the Service will be uninterrupted or error-free
- The safety, quality, or legality of food or beverages obtained through the Service
STASH IS A MARKETPLACE PLATFORM. We are not responsible for the preparation, quality, or safety of any food or beverages. Any disputes regarding items should be resolved between the consumer and merchant.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, 5TREE LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING FROM:
- Your use of or inability to use the Service
- Any food or beverage obtained through the Service
- Unauthorized access to your account
- Any third-party conduct on the Service
OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF $50 OR THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.
12. Indemnification
You agree to indemnify and hold harmless 5Tree LLC, its officers, directors, employees, and agents from any claims, losses, or damages (including reasonable attorney's fees) arising from your use of the Service or violation of these Terms.
13. Governing Law
These Terms are governed by the laws of the State of North Carolina, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Durham County, North Carolina.
14. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms and revising the "Last Updated" date. Continued use of the Service after changes constitutes acceptance.
